Terms of service.

Access to and use of the services offered by Hillhouse Medical LLC (hereinafter “Hillhouse Medical”, “Hillhouse Medical LLC”, “we”, “us”, and/or “our”) is subject to the acceptance of these Terms and Conditions (“Terms and Conditions”). By accessing, using, or obtaining any content, products, or services through our offices or website, you, the purchaser and/or traveler (hereinafter “the customer”, “the traveler”, “user”, and “you/your”) agree to be bound by these Terms and Conditions. Agreeing to the Terms and Conditions creates a binding agreement between you and Hillhouse Medical LLC

  1. Scope of Services

    1. Services provided by us. Hillhouse Medical offers services consisting in the advice, consultancy and arrangement of travel plans and packages between the customer and medical service providers, including but not limited to hospitals and clinics (“Providers”) outside of the continental United States.
      We provide information about healthcare professionals in different countries and the user can choose a medical provider according to the user’s needs. We do not refer to specific providers nor provide medical opinions on a specific case. The information facilitated and communicated by us does not constitute medical advice nor serves as medical consultation or examination.
      All information provided by us is collected to the best of our skills. However, Hillhouse Medical does not guarantee and cannot verify that the information granted to us by different providers is accurate, correct, or complete. We are not a medical referral service nor are medical professionals and will not discuss or advise medical issues or treatments. As such, the user agrees to not hold Hillhouse Medical responsible for any information about or facilitated by providers that is incomplete, inaccurate, misleading, or untrue. The information granted by providers to Hillhouse Medical and offered to the user shall not be considered a recommendation or endorsement of the quality, service level or qualification of any Provider by Hillhouse Medical.

    2. Additional services. With the goal of providing with a flawless and streamlined experience, we may offer additional services including, but not limited to, medical records and documents translation, on-site interpreters, visa and travel documentation-related handling of documents, accommodation of companion, and medical case management. As with all other services offered by us, these services will be at an individual cost and shall not be considered medical services.
      Since these services are rendered by third parties outside of our control, Hillhouse Medical reserves the right to update the prices for these additional services at its discretion at any point before payment. 

    3. Agreements with providers and third parties. All agreements that arise between a provider and the user, even those that result from the information facilitated by us, shall be deemed to be exclusively between the user and the provider, and Hillhouse Medical assumes rights, obligations or responsibilities that arise from the contract formed between user and provider. Hillhouse Medical shall not be a party to any contract or agreement between user and provider, and as such assumes not responsibility or liability for any dispute of any nature, including civil and criminal, that arises between user and provider.

    4. Selection of providers. The user agrees to assume all responsibility related to the selection of a provider, and Hillhouse Medical assumes no responsibility or liability for services rendered by a provider. The user agrees not to hold Hillhouse Medical liable for any claim, including but not limited to medical malpractice, civil, and criminal, that arises directly or indirectly from the services rendered by a provider or medical services or additional services.

  2. Payments, down payments, and deposits

    1. Payment handling. Hillhouse Medical processes all payments and monetary transactions through its platform via a secure third-party service.

    2. Down payments and deposits. As part of the process to secure a booking with a provider, we will require the user to provide a down payment or credit card deposit, with an amount that will be determined as part of the quote provided to the user.

    3. Payment period. Unless otherwise stated in the service order, all payments should be made to Hillhouse Medical within ten business days of the date of the quote or service order. If services are to be rendered before the ten-day period expires, these shall be paid in full no later than the day before the services are rendered.

  3. Cancellation and refund policy

    1. User cancellation. The user may cancel a part of, or the totality of, the treatment and/or travel plans at any point before services are rendered.

    2. Cancellations with providers or third parties. Due to the nature of the services provided by Hillhouse Medical, cancellation policies vary by providers and will be included in the quote. We do not have control over these policies as well as cancellation fees and as such, the user agrees not to hold Hillhouse Medical liable for down payments or deposits lost to providers and/or third parties due to cancellations.

    3. Refunds. In case of cancellation, Hillhouse Medical will refund the totality of the payments made except for those that providers and third parties, according to their own terms and conditions and/or contracts, determine to be non-refundable. These will be handled in a case-by-case basis and Hillhouse Medical will work with the user in seeking the largest refundable amount possible.

    4. Rescheduling. When the user needs to reschedule either part of or the totality of the treatment and/or travel plans, Hillhouse Medical shall allocate all payments made by the user to the new treatment and/or travel plans, except for those that providers or third parties determine to be non-refundable.

    5. Force Majeure. 

  4. User’s obligations

    1. Age. Users of our services must be 18 years of age at the time of contracting our services. All users under the age of 18 or that do not have the capacity to contract our services, shall do so through a parent or legal guardian.

    2. Travel documentation. The user is solely responsible for possessing all travel documentation required by all countries visited during the medical treatment. T

    3. Risks and safety. The user assumes all risks associated with the medical treatment as well as travel. While we will collect and inform the user to the best of our ability on these risks, it is ultimately the obligation of the user to have all information at hand, both medical and travel-related, to make a decision. 

    4. Travel insurance. Hillhouse Medical does not offer travel insurance, and strongly recommends the user to purchase cancellation protection and travel insurance.

  5. Liability of Hillhouse Medical

    1. Quality of services rendered. Unless otherwise stated in these Terms and Conditions or on a service order or quote, Hillhouse Medical does not guarantee the quality of the services rendered by it, nor by any of the Providers.
      Hillhouse Medical’s liability is limited to acts by directors, employees or agents resulting in a breach of obligations by our directors, employees, or agents.

    2. Information facilitated by Hillhouse Medical. The user agrees not to hold Hillhouse Medical liable for interpretation, accuracy or content of any information provided to the user by our providers or any other third party on Hillhouse Medical’s website. Hillhouse Medical does not assume liability for the accuracy, relevancy or interpretation of any information stored in any website external to Hillhouse Medical’s and that was linked to in our website.

    3. Price and currency fluctuations. Prices charged for services will be stated in the service order and are not subject to increase for any reason including increases in materials, components, labor costs, market fluctuations or foreign currency exchange rate fluctuations, only during the period stated in the service order. If the user fails to make payment during the period state in the service order, or requests changes or adjustments to the treatment, those prices will be subject to adjustments according but not limited to the reasons stated above.

    4. Force Majeure. Any delay or failure of Hillhouse Medical to perform its obligations under the service order will be excused if and to the extent that Hillhouse Medical is unable to perform specifically due to an event or occurrence beyond its reasonable control and without its fault or negligence, such as but not limited to: acts of God, restrictions, prohibitions, priorities or allocations imposed or actions taken by a governmental authority, embargoes, fires, explosions, natural disasters, riots, wars or pandemics. The user assumes these risks, and while Hillhouse Medical will use all diligent efforts to mitigate the adverse effect of any force majeure event and resume full performance of the contract, the user agrees not to hold Hillhouse Medical liable for such delay or failure to perform under force majeure.

    5. Information provided or facilitated. Hillhouse Medical compiles and provides information provided by third parties to the best of its ability. However, the user agrees not to hold Hillhouse Medical liable for any technical or typographical inaccuracy or error on our website or on a service order or quote. We reserve the right to correct or update these errors 

    6. Liability of agents of Hillhouse Medical. Unless otherwise stated in these Terms and Conditions, the user agrees that in any situation or clause where user will not hold Hillhouse Medical liable, the waiver of liability will extend to Hillhouse Medical’s directors, officers, employees, members, agents, representatives, attorneys, servants and successors. 

  6. No liability for services rendered by third parties

    1. Limitation of liability. The user agrees not to hold Hillhouse Medical liable for any damages direct or indirect that arise from the rendition of services by third parties or medical providers, nor for any incomplete or incorrect information.

  7. Data protection

    1. Scope of data protection. The user agrees that for Hillhouse Medical to provide its services, it is necessary to collect personal data required for the administration and rendition of services. User acknowledges that Hillhouse Medical shall collect, process, register and transfer personal and medical data to its providers and third-party services.

    2. Sharing or selling of personal data. All collection of personal and medical data and information by Hillhouse Medical is done with the purpose of facilitating the selection of providers for medical procedures and all services related to it. Hillhouse Medical does not sell or share user’s information to any third party without prior written consent. 

  8. Validity and Change of the Terms and Conditions

    1. Other agreements. By contracting our services, user agrees that these Terms and Conditions shall be the only and exclusive agreement governing the relationship between the parties.

    2. Validity of Terms and Conditions. These Terms and Conditions will remain in force until change or cancellation by Hillhouse Medical. In contracting with us, user agrees to them, and shall remain bound by them during the period when services are rendered or to be rendered.

    3. Rejection of Terms and Conditions. If at any point user rejects these Terms and Conditions, user shall stop the user of Hillhouse Medical services immediately.\

    4. Changes to Terms and Conditions. Hillhouse Medical reserves the right to amend or modify these Terms and Conditions. Any changes to the Terms and Conditions shall be notified to the user in the website or by private communication once the user has contracted any of the services provided by Hillhouse Medical.

    5. Inconsistencies with other Terms and Conditions or contracts. These Terms and Conditions shall apply to all services provided to the user by Hillhouse Medical. However, if any service order or quote specifies different terms for a specific service, the specific terms shall apply over these Terms only to the extent of the inconsistency.

    6. Terms and Conditions of third parties or providers. Medical providers or third parties contracted by the user may have their own Terms and Conditions. Those Terms and Conditions shall be applicable exclusively to the services rendered by said provider or third party and the user, and any provision directly or indirectly pertaining to Hillhouse Medical is outright rejected.

    7. Partial nullity. Should any provision or clause in these Terms and Conditions be declared null or void, or be agreed by the parties to be void, the remaining ones shall prevail in their own terms. The parties shall negotiate to find a reasonable, good-faith solution should an essential part of the Terms and Conditions be voided, considering the spirit hereof and the purpose of the cancelled provision.

  9. Applicable law and venue

    1. Governing law. These Terms and Conditions are governed by and construed in accordance with the laws of the State of Washington, without regard to principles of conflict of laws.

    2. Jurisdiction. The user understands and agrees to submit to the personal and exclusive jurisdiction of the courts of the State of Washington to resolve any legal matter arising from the Terms and Conditions or related to the use of the services provided and/or rendered by Hillhouse Medical.

    3. Court nullity of Terms and Conditions. Should a court of law having jurisdiction rule that any provision in this agreement is invalid, that provision will be removed from the Terms and Conditions agreed between Hillhouse Medical and the user, and the remaining clauses and terms will continue to be valid and in full force and effect.

  10. Privacy Statement.

    1. Use of website. Hillhouse Medical does not collect personally identifying information about the user when visiting our website unless that information is expressly provided by the user. 

    2. Use of personal information provided by the user. Hillhouse Medical uses the information provided by the user to respond to inquiries and provide the services that Hillhouse Medical renders.
      Upon express and written authorization, Hillhouse Medical may gather information from third parties such as health care providers or physicians. All personally identifiable information will be used only as necessary to provide with Hillhouse Medical’s requested services 

    3. Protection of personally identifiable information and data. All data is retained in a secured fashion and protected against misuse, loss and unauthorized access, disclosure, alteration, or destruction, and is handled exclusively by authorized employees for authorized business purposes. Despite our best efforts, Hillhouse Medical does not guarantee that personally identifiable information will not be accessed by malign third parties through electronic communications or disruptions.

Third parties. Hillhouse Medical assumes no responsibility for the collection, handling or distribution of personally identifiable information by third parties contracted by the user through our services.
